43 Acting Chief Executive Officer

(1)

The Board may appoint a person to act as Chief Executive Officer:

(a)

during a vacancy in the office of Chief Executive Officer, whether or not an appointment has previously been made to that office; or

(b)

during any period, or during all periods, when the Chief Executive Officer is absent from duty or from Australia or is, for any other reason, unable to perform the duties of the office of Chief Executive Officer.

Note:

For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901.

(2)

Before appointing a person to act as Chief Executive Officer, the Board must consult the Minister.

(4)

Unless the contrary intention appears, a reference in this Act other than this section, to the Chief Executive Officer is taken, if a person is acting as Chief Executive Officer, to be a reference to the person so acting.
