83 Preliminary notices issued under old Code
This regulation applies to an old Code application if:
a notice was issued under subsection 11A(3) of the old Code requiring the applicant to rectify defects in the application; and
the period for rectifying the defects (the rectification period) ends after 30 June 2015; and
the applicant has not rectified the defects before 1 July 2015.
Paragraph 11A(3)(a) of the old Code provides that the notice must require the applicant to rectify the defects within 1 month or such further period as the APVMA allows.
For subitem 58(1) of Schedule 6 to the Amendment Act, the APVMA must:
for an application made under section 10 of the old Code:
complete a preliminary assessment of the application under section 11 of the new Code within 1 month of the earlier of the following dates:
the day the applicant has rectified all of the defects;
the last day of the rectification period; and
comply with the requirements of subsection 11(2) and (3) of the new Code; and
for an application made under section 27 of the old Code:
complete a preliminary assessment of the application under section 28 of the new Code within 1 month of the earlier of the following dates:
the day the applicant has rectified all of the defects;
the last day of the rectification period; and
comply with the requirements of subsection 28(2) and (3) of the new Code.
