40 Bribery by medical service providers
A person commits an offence if:
(a)
the person is a medical service provider; and
(b)
the person dishonestly:
(i)
provides a benefit to another person; or
(ii)
causes a benefit to be provided to another person; or
(iii)
offers or promises to provide a benefit to another person; or
(iv)
causes an offer or a promise to provide a benefit to be made to another person; and
(c)
the person does so intending to encourage the other person to request a pathology service in respect of treatment provided under this Act.
Penalty: 120 penalty units or imprisonment for 2 years.
