48 Summons to person to attend hearing
If the Ombudsman reasonably believes that a person has, or could take reasonable steps to obtain, information or documents relevant to the inquiry, the Ombudsman may summon a person, in writing, to appear at a hearing to give evidence and to produce documents specified in the summons.
A person served with a summons to appear at a hearing must not:
fail to attend as required by the summons; or
fail to attend from day to day.
Penalty: 30 penalty units.
Paragraph (2)(b) does not apply if the person is excused, or released from further attendance, by the Ombudsman.
A defendant bears an evidential burden in relation to the matter in subsection (3) (see subsection 13.3(3) of the Criminal Code).
