97 Effect of person’s death

(1)

Any act that may be done under or for the purposes of this Act by a person who is eligible for the BSWAT payment scheme (including the acts of registering or applying for the scheme) may be done, on behalf of a deceased person whose eligibility for the scheme is continued by subsection 6(5), by the deceased person’s legal personal representative.

(2)

An act done by a legal personal representative on behalf of a deceased person because of this section has effect for the purposes of this Act as if it had been done by the person.

(3)

The rules may make provision for the application of this Act in relation to deceased persons, including by making modifications of this Act not inconsistent with subsection (1) or (2).

(4)

A reference in subsection (1) or (2) to an act that may be done, or an act done, includes a reference to refraining from doing an act in order to give effect to a decision.
