Holding office after withdrawal
123 Holding office after withdrawal
The rules of a newly registered organisation may provide that a person who:
was elected to office (the constituent office) in the constituent part that withdrew from an amalgamated organisation to form the new registered organisation; and
held that office immediately before withdrawal day;
holds the equivalent office in the newly registered organisation as if he or she were elected under the rules of the newly registered organisation.
However, the rules must not permit a person to hold office after the later of:
the day that would have been the person’s last day of term in the constituent office if the withdrawal had not occurred; and
the first anniversary of the withdrawal day.
