33.17 Form of application for stay of Tribunal decision

A person who wants to make an application for an order under subsection 178(2) of the ART Act for a stay of a Tribunal decision:

(a)

must file an interlocutory application; and

(b)

may, in an urgent case, make the application without notice.

Note 1:

Without notice is defined in the Dictionary.

Note 2:

A Registrar will fix a return date and place for hearing and endorse those details on the interlocutory application.
