34.109 Application for review of decision not to accept claim for registration

(1)

If the Native Title Registrar has refused to accept a claim for registration, the applicant may, within 42 days after the date of notification of the decision, apply to the Court for a review of that decision under section 190F(1) of the Native Title Act by filing an originating application, in accordance with Form 108.

(2)

Each State and Territory having jurisdiction over the area to which the main application relates must be joined as a respondent to the application.

(3)

The Commonwealth may be joined as a respondent to the application.
