35 Alternative to steps set out in sections 33 and 34—approving the draft code of practice or draft variation

(1)

After the submission period, the Authority must:

(a)

approve the draft code of practice or draft variation; or

(b)

reject the draft code of practice or draft variation.

Note:

The Board must not delegate its powers to act on behalf of the Authority under this subsection—see section 150.

(2)

If another code of practice would be superseded, in whole or in part, by the Authority’s decision under subsection (1), the Authority must:

(a)

revoke the other code of practice (if it would be wholly superseded); or

(b)

vary the other code of practice (if it would be partly superseded).

(3)

The Authority must give public notice of its decision.

(4)

The notice must:

(a)

specify the date of effect of the decision; and

(b)

state how to obtain further information about the decision and the reasons for it.

(5)

The Authority must also give written notice of its decision to the Forum on Food Regulation.
