36 Varying special permits on application
The CEO may, on application by the holder of a special permit, vary the permit if:
the CEO is satisfied that, if the CEO were asked to grant the special permit (as proposed to be varied), the CEO would decide to grant the permit; and
the CEO has taken into account any relevant public comments received in response to an invitation under paragraph 33(1)(aa) of the Act about the application.
Examples of a variation include imposing a condition on the permit, or varying or revoking a permit condition.
The application must:
be in the form approved by the CEO; and
set out, or be accompanied by, such information in relation to the proposed variation as is required by the form.
Regulation 33 applies to the imposition or variation of a condition under this regulation as if a reference in regulation 33 to the grant of a special permit were a reference to a variation of a special permit.
