40B Period for making a decision on an application to vary a special permit—extension agreed with applicant
The decision period for an application to vary a special permit is extended if the CEO and applicant agree in writing to the extension.
As soon as practicable after extending the period under subregulation (1), the CEO must give written notice of the extension to:
if the extension relates to a special export permit—the following:
the competent authority of the importing country for the permit;
the competent authority of each transit country (if any) for the waste to which the application relates; or
if the extension relates to a special import permit—the competent authority of the exporting country for the permit; or
if the decision relates to a special transit permit—the competent authority of the OECD country from which the waste is to be exported.
