106ZPA Constitution of Determining Authority
The Determining Authority consists of:
a Chair, who is to be a medical practitioner; and
a member, who is not to be a practitioner; and
other members, of whom there is to be one of each kind of practitioner in relation to which the Professional Services Review Scheme established by this Part applies.
See subsection 81(1) for the definition of practitioner.
However, for the purposes of the performance of the functions and the exercise of the powers of the Authority in respect of:
a particular agreement between the Director and a person under review entered into under subsection 92(1) that is referred by the Director to the Authority for ratification; or
a particular report made to the Authority by a Committee;
the Authority is to be constituted by:
the Chair; and
the member referred to in paragraph (1)(b); and
the member or members referred to in paragraph (1)(c) who are practitioners in the same professions as the person or persons who rendered or initiated the services to which the agreement or report relates.
