124L Summons to give evidence etc
A Committee that is conducting, or that proposes to conduct, a hearing may, by writing signed by the Chairperson, summon a person to appear at the hearing and to produce such documents (if any) as are referred to in the summons, and a person so summoned shall not:
fail to appear as required by the summons; or
fail to appear and report from day to day unless excused, or released from further attendance, by the Chairperson.
Penalty: 10 penalty units.
Subsection (1) does not apply if the person has a reasonable excuse.
The defendant bears an evidential burden in relation to the matter in subsection (2). See subsection 13.3(3) of the Criminal Code.
An offence under subsection (1) is an offence of strict liability.
