17 Medicare benefits not payable in respect of certain medical expenses

(1)

A medicare benefit is not payable in respect of a professional service if:

(a)

the medical expenses in respect of that service have been paid, or are payable, to a recognized hospital;

(b)

the medical practitioner who rendered the service was acting on behalf of an organization that was, when the service was rendered, an organization prescribed for the purposes of this paragraph;

(c)

any part of the service was rendered on the premises of an organization that was, when the service was rendered, an organization referred to in paragraph (b); or

(d)

any amount has been paid, or is payable, in respect of the service in accordance with a scheme to which section 42B applies.
