17 Removal from office
The Minister may remove a person from the Council on the ground of misbehaviour, physical or mental incapacity or a breach of his or her duties under the Commonwealth Authorities and Companies Act 1997.
The Minister must remove a member from the Council if:
the member becomes disqualified from managing corporations under Part 2D.6 of the Corporations Act 2001; or
the member has, in the Council's opinion, breached his or her duties under section 22A, 22B, 22C, 22D, 22E or 22F as a member; or
the member is, in the Minister's opinion, incapable of performing his or her duties.
In forming an opinion for the purposes of paragraph (2)(c), the Minister must have regard to the advice of the Council.
