81 Former Presidential Members entitled to pension

Subject to subsection 5(1) of the Judges’ Pensions Act 1968, a person:

(a)

who, immediately before the commencement, was a Presidential Member of the former Commission;

(b)

to whom subsection 6(1) of the Judges’ Pensions Act 1968 would have applied if, immediately before the commencement, that person had attained the age of 60 years and retired; and

(c)

who, immediately after the commencement, does not hold an office of Presidential Member of the new Commission;

shall be entitled to a pension under subsection 6(1) of the Judges’ Pensions Act 1968 as if the person had retired and attained the age of 60 years immediately before the commencement.
