19B Transfer of licences
The CEO may transfer a licence, other than a suspended licence, from the licensee to another person (the transferee) on a joint application by the licensee and the transferee.
An application must:
be in the approved form; and
be signed by both applicants; and
be given to the CEO.
The CEO must not grant an application unless satisfied that the transferee is a fit and proper person to be granted a licence.
The mandatory fit and proper person considerations are set out in section 13B.
A decision by the CEO transferring a licence, or refusing to transfer a licence, must be by written notice given to the applicants.
A notice of a decision refusing to transfer a licence must state the reasons for the decision.
If the CEO transfers a licence, the transferee is taken to be the licensee on and after the date of the transfer.
