Ozone Protection and Synthetic Greenhouse Gas Management Act 1989

A regulated HCFC activity is the manufacture or import of HCFCs under a controlled substances licence.

This Part does not apply to the import of HCFCs for use on board ships or aircraft in certain circumstances: see section 12B.

For the purposes of this Act, the quantity of HCFCs that is taken to be involved in regulated HCFC activities engaged in by a licensee in a period is the greater of the quantity worked out using the following formula and nil:

For the purposes of subsection (2), the quantity of HCFCs exported by a licensee in a period is taken not to include any quantity exported under a direction given to the licensee under section 35A (direction to export HCFCs if quota exceeded).
