29 Limits on power to allocate reserve HCFC quotas
The CEO must not allocate a reserve HCFC quota unless satisfied that exceptional circumstances exist.
For the purposes of subsection (1), exceptional circumstances exist if, and only if:
the use of the relevant HCFC is essential for medical, veterinary, defence or public safety purposes; and
there is no practicable alternative to that use; and
without the allocation, the HCFC will not be available, in the quantities required for that use, within a reasonable period.
The CEO must not allocate a reserve HCFC quota for a year, or part of a year, if the sum of the amounts of all other reserve HCFC quotas allocated for that year, or any part of that year, equals the reserve HCFC quota limit for that year.
