35 Review of decisions by Administrative Review Tribunal
Applications may be made to the Administrative Review Tribunal for review of a decision of the ACMA under clause 25 or 26 to refuse to issue a facility installation permit if the ACMA has not held a public inquiry in relation to the permit.
If the ACMA:
makes a decision of a kind covered by subclause (1); and
gives to the person or persons whose interests are affected by the decision written notice of the making of the decision;
that notice is to include a statement to the effect that, subject to the Administrative Review Tribunal Act 2024, application may be made to the Administrative Review Tribunal for review of the decision.
A failure to comply with subclause (2) does not affect the validity of a decision.
In this clause:
decision has the same meaning as in the Administrative Review Tribunal Act 2024.
