Erection of rural workers’ dwellings on land in Zones RU2 and C3
4.2B Erection of rural workers’ dwellings on land in Zones RU2 and C3
The objectives of this clause are as follows—
to facilitate, on the same land, the provision of adequate accommodation for employees involved in existing agricultural activities, including agricultural produce industries,
to maintain the non-urban landscape and development characters of certain rural and conservation zones.
This clause applies to land in the following zones—
Zone RU2 Rural Landscape,
Zone C3 Environmental Management.
Development consent must not be granted for the erection of a rural worker’s dwelling on land to which this clause applies unless the consent authority is satisfied that—
the development will be on the same lot as an existing lawfully erected dwelling house or dual occupancy (attached), and
the development will not impair the use of the land for agricultural activities, including agricultural produce industries, and
the agricultural activity or agricultural produce industry has an economic capacity to support the ongoing employment of rural workers, and
the development is necessary considering the nature of the existing or proposed agricultural activity or agricultural produce industry occurring on the land or as a result of the remote or isolated location of the land, and
there will be not more than one rural worker’s dwelling on the lot, and
the development will be a single storey building with a maximum floor area of 120 square metres or not more than 20% of the floor area of any existing dwelling house on that land, whichever is greater.
