Campbelltown Local Environmental Plan 2015

This clause applies to Lot 3900, DP 1170905, Raby Road, Kearns.

The objectives of this clause are to—

permit the following—

subdivision of land to separate existing buildings and facilities associated with a registered club from the remainder of the land,

subdivision of land in accordance with the Community Land Development Act 2021, and

facilitate the dedication of land for public purposes of lots that do not contain existing buildings and facilities associated with a registered club, and

preserve the visual quality of the hills in the area.

Despite clause 4.1(3), the size of a lot resulting from subdivision of land to which this clause applies may be less than the minimum lot size shown on the Lot Size Map in relation to the land if the consent authority is satisfied that—

the lot results from a subdivision of the land into 2 lots, and

one of the lots—

will have an area of at least 3ha but not more than 4ha, and

will contain all existing buildings and facilities associated with a registered club on the land, and

the other lot will be subdivided in accordance with subclause (4).

Despite clause 4.1AA(3), the size of a lot resulting from subdivision of land to which this clause applies may be less than the minimum lot size shown on the Lot Size Map in relation to the land if the consent authority is satisfied that—

the lot results from a subdivision carried out under the Community Land Development Act 2021 for a neighbourhood scheme, and

the lot will have an area of at least 5,000m², and

no more than 52 lots created by the subdivision will be used for the purposes of dwelling houses.

Subclause (4)(b) does not apply to the following lots—

a lot comprising neighbourhood property,

a lot that will be dedicated to the Council for a public purpose.
