Caravan parks and manufactured home estates
7.9 Caravan parks and manufactured home estates
The objectives of this clause are as follows—
to ensure the social and economic well-being of residents of caravan parks and manufactured home estates at risk of displacement due to the redevelopment of caravan parks and manufactured home estates,
to encourage the retention of caravan parks and other forms of low-cost accommodation on certain land in the Central Coast,
to prevent development that would result in a loss of low-cost accommodation on land unless sufficient comparable accommodation is available elsewhere in the Central Coast.
This clause applies to development on land identified as “Caravan Parks and Manufactured Home Estates” on the Manufactured Home Estate Map, other than development for the following purposes—
caravan parks,
camping grounds,
manufactured home estates,
public utility undertakings.
Development consent must not be granted for development to which this clause applies unless the consent authority has considered the following—
whether the proposed development is likely to reduce the availability of low-cost accommodation on the land,
whether sufficient comparable accommodation is available to meet the demand for low-cost accommodation in the Central Coast,
whether the proposed development is likely to cause adverse social and economic impacts on existing residents or the general community of the Central Coast,
whether adequate arrangements have been made to assist existing residents to find alternative and comparable accommodation in the Central Coast,
whether the cumulative impact of the loss of low-cost accommodation is likely to significantly decrease the availability of low-cost accommodation in the Central Coast.
Development consent must not be granted for development to which this clause applies unless the consent authority is satisfied that—
sufficient accommodation will be available to accommodate the maximum number of persons who could be accommodated by any existing development on the land from time to time in the 12 months before 27 February 2004, and
the accommodation referred to in paragraph (a) will be comparable to that provided on the land in relation to price, facilities, services and type of tenure.
In this clause—
manufactured home estate has the same meaning as in the Local Government Act 1993.
