Criminal Procedure Regulation 2017

The Secretary may issue guidelines, not inconsistent with this Part, from time to time with respect to any or all of the following matters—

the keeping of records in respect of participation in the program or approved traffic courses undertaken or completed as part of the program,

the monitoring of participation of referred traffic offenders in the program and in approved traffic courses undertaken or completed as part of the program,

the functions and responsibilities of approved traffic course providers in connection with the program,

the content and conduct of approved traffic courses,

the process of identifying the availability of a suitable approved traffic course,

the undertaking of an approved traffic course otherwise than pursuant to a program participation order,

the administration of the program,

any other matter in respect of which guidelines are permitted or required by this Part.

Without limiting subclause (1), the guidelines may include provisions that—

apply generally, or

apply only in relation to specified persons, courts, groups or other bodies, or

apply only in specified circumstances, or

do a combination of the things referred to in paragraphs (a), (b) and (c).

Guidelines must be published on the Department’s website.
