If a document is authorised or required under this Act to be served on a landholder who is a native title holder, service of the document is taken to be effected in accordance with section 383 if the document is served on a registered native title body corporate in relation to the land concerned.

If no approved determination of native title (within the meaning of the Commonwealth Native Title Act) exists in relation to the land concerned—

a document authorised or required under this Act to be served on a landholder cannot, for the purposes of serving it on a landholder who is a native title holder who cannot be identified, be served in the manner prescribed by section 383 (2), and

such a document may, however, be served on any such landholder by serving it, in a manner authorised by section 383 (1) and (4), on—

any representative Aboriginal/Torres Strait Islander bodies for an area that includes the land concerned, and

any registered native title claimants in relation to the land concerned.
