Grant or renewal of licence or permit
13 Grant or renewal of licence or permit
The Secretary may, on application by a person, grant or renew a poppy licence.
The Secretary may, on application by a person, grant a poppy permit.
Subject to this Act, a poppy licence or poppy permit remains in force for the period specified in the licence or permit on its grant or renewal.
The period specified must not exceed—
for a cultivation licence—3 years, or
for a processing licence or poppy permit—1 year.
An application for renewal of a licence must be made within the period required by the regulations before the date of expiry of the licence but the Secretary may accept a late application for renewal of a licence on payment of the late application fee fixed by the regulations.
If an application for renewal of a licence is duly made or a late application is accepted by the Secretary, the licence is taken to continue in force until the Secretary notifies the applicant of a decision to grant or refuse the application.
