164 Duty of witnesses
(1) This section applies to a person who signs an electoral paper as a witness (the witness) for another person.
The witness commits an offence if:
the witness signs the electoral paper for the other person; and
the witness:
(i) fails to take reasonable steps to satisfy himself or herself of the identity of the other person; or
fails to see the other person sign the electoral paper.
Maximum penalty: 50 penalty units.
(3) An offence against subsection (2) is an offence of strict liability.
The witness commits an offence if the witness:
signs the electoral paper for the other person; and
(b) knows the other person has made a misleading statement in the electoral paper.
Maximum penalty: 200 penalty units or imprisonment for 12 months.
