Delegation by committee
38 Delegation by committee
Subject to a restriction or direction that may be imposed or given by ordinary resolution passed at a general meeting of the committee, the committee may delegate to one or more of its members or a person employed or engaged under regulation 39, either generally or otherwise as specified in the instrument of delegation, all or any of its powers, functions and duties, other than this power of delegation.
A power, function or duty delegated under this section, when exercised or performed by the delegate, shall, for the purposes of the Act, these Regulations or the By-laws, be deemed to have been exercised by the committee.
A delegation under this regulation does not prevent the exercise of a power or the performance of a function or duty by the committee.
