34 Repeated offences and prohibition from handling dangerous goods
Where a person is found guilty of an offence against this Act or the Regulations, the court may, in addition to any other penalty, order that the person be prohibited for a specified period from being involved generally in, or in relation to specific aspects of, the handling of dangerous goods.
When making an order under subsection (1), the court must take into account:
the person's record in relation to dangerous goods;
the prior convictions of the person that relate to the handling of dangerous goods;
the circumstances surrounding the commission of the offence for which the person is being sentenced; and
other matters the court thinks fit.
A person must not contravene or fail to comply with an order under subsection (1).
Maximum penalty: In the case of a body corporate – 2 160 penalty units.
In the case of a natural person – 430 penalty units or imprisonment for 2 years.
