35 Deemed unprofessional conduct

A health care provider's conduct constitutes unprofessional conduct for the Health Practitioner Regulation National Law and any other law prescribed by regulation if:

(a)

the health care provider believes on reasonable grounds that an adult has impaired decision making capacity to make a health care decision; and

(b)

administering the health care requires a health care decision made in accordance with this Act; and

(c)

the health care provider administers the health care to the adult without that health care decision.
