12.04 Orders where joinder prejudicial, &c.

Despite rules 12.01 and 12.02, where a joinder of claims or parties may:

(a)

embarrass or delay the hearing of proceedings;

(b)

cause prejudice to a party; or

(c)

be otherwise inconvenient;

the Court may order that:

(d)

there be separate hearings; or

(e)

a claim be excluded; or

(f) a party be compensated by an award of costs or otherwise for being required to attend a part of a hearing in which the party has no interest; or

(g) a party be relieved from attending a part of a hearing in which the party has no interest; or

(h) a person joined as a party cease to be a party, with or without the condition that the person is to be bound by the determination of the questions in the proceedings.
