Part 21Evidence generally
21.01 Manner of giving evidence
Except where otherwise provided by or under an Act or by these Rules or unless the Court orders otherwise, the evidence of a witness is to be given:
(a) at the hearing of proceedings – orally on oath or, subject to rule 21.02, by affidavit; and
(b)
on any other application in proceedings – by affidavit.
