21.06 Person about to leave territory
(1) If, on the application of a party, the Court is satisfied by evidence on oath that a person is:
(a) able to give material evidence or to produce relevant or material documents or things relating to proceedings; and
(b) likely to be absent from the Territory at the time the proceedings come on for hearing,
the Court may order that, before the hearing:
the person must give evidence;
the person must produce the documents or things.
An order under subrule (1) is to be served:
personally on the person named in the order; and
on all other parties to the proceedings.
(3) Section 194 of the Evidence (National Uniform Legislation) Act 2011 and rule 23.08 apply in relation to the order as if it were a summons.
