48.02 Attachment of earnings order

(1)

If a registrar is satisfied that a judgment debtor:

(a) is a person to whom earnings are payable or are likely to become payable; and

(b)

has failed to comply with an order for the payment of money,

the registrar may make an attachment of earnings order in accordance with this Part.

(2) Where an attachment of earnings order is in force, a registrar must not:

(a)

issue a warrant;

(b)

issue other process of execution; or

(c)

make an order,

for the enforcement of the order to which the attachment of earnings order relates unless the Court orders otherwise.
