48.14 Determination of earnings
(1)
An employer may apply to the Court for a determination as to whether payments of a particular description are earnings for the purpose of an attachment of earnings order.
(2)
An application under subrule (1) is to be made in the proceedings in which the attachment of earnings order is made.
(3)
An applicant under subrule (1) does not incur a liability for failing to comply with the attachment of earnings order with respect to a payment of earnings to the judgment debtor of the description specified in the application while the application, or an appeal from an order made at the hearing of the application, is pending.
