52.02 Determination of application

Before determining an application for the appointment of a receiver by way of equitable execution, the Court:

(a)

must have regard to:

(i)

the amount claimed by the judgment creditor;

(ii)

the amount likely to be obtained by the receiver; and

(iii)

the probable costs of his appointment; and

(b)

may direct an inquiry on these or any other matters.
