53.01 Application for sequestration order

(1) A person seeking to enforce an order for the payment of money into the Court may apply for a sequestration order referred to in section 22(15) of the Local Court (Civil Procedure) Act 1989.

(2) Where a person applies for a sequestration order against a corporation, the person may apply for an order for the sequestration of the property of:

(a)

the corporation;

(b)

an officer of the corporation; or

(c)

the corporation and an officer of the corporation.

(3)

A person applies for a sequestration order by filing:

(a)

a sequestration summons in accordance with Form 53A; and

(b)

an affidavit in support of the sequestration summons.

(4) A registrar must fix a date, time and place for the hearing of the application and mark them on the sequestration summons.
