22 Requirement for licence
(1)
The occupier of premises where more than the number of dogs or the number of dogs of a class of dog or classes of dogs, as determined by the Council, are usually kept is guilty of an offence unless the premises are licensed.
(2)
It is a defence to a prosecution for an offence against clause
(1)
if the occupier of the premises proves that the dogs or the dogs of the class of dog or classes of dogs had not been kept at the premises for a period of 3 consecutive months before the date of the alleged offence.
