29 Dogs causing nuisance
The owner of a dog that, either by itself or in concert with other dogs, is a nuisance is guilty of an offence.
For the purposes of this by‑law, a dog is a nuisance if it is injurious or dangerous to the health of the community or of an individual, or behaves repeatedly in a manner contrary to the general interest of the community or an individual.
Without limiting the generality of clause (2), a dog is a nuisance if it:
creates a noise, by barking or otherwise, which persistently occurs or continues to a degree or extent which has a disturbing effect on the state of reasonable mental, physical or social well‑being of a person;
repeatedly barks when people or vehicles use a public place in the vicinity of the premises where the dog is kept; or
subject to these By‑laws, repeatedly defecates in such a place as to cause annoyance to a particular person.
The owner of a dog is not guilty of an offence against this by‑law, by reason of the actions of the dog referred to in clause (3)(c), if the owner immediately removes the faeces and disposes of it in the gutter of a road with a constructed curb, a public garbage receptacle or on his or her own property.
