68 Register of qualified persons
(1) The NT EPA must cause to be established and maintained a register of:
(a) persons qualified to perform environmental audits for the purposes of an environmental audit program; or
persons qualified to engage in a prescribed activity.
(2) A person who is qualified to perform environmental audits for the purposes of an environmental audit program or to engage in another activity that is prescribed may:
in the approved form; and
on payment of the prescribed fee in relation to the activity,
apply to the NT EPA to be registered in a register established under subsection (1).
(3) The NT EPA may register in a register maintained under subsection (1):
(a) a qualified person who has applied under subsection (2) to be registered; or
(b) a class of persons specified in the register, where the NT EPA is of the opinion that the members for the time being or from time to time of the class of persons should be registered by virtue of qualifications or experience.
Where the NT EPA registers a person under subsection (3)(a):
(a) the NT EPA must notify the person of the registration and the period of the registration; and
(b) subject to this section, the registration remains in force for the period specified in the notice under paragraph (a).
(5) The NT EPA, or a court, may cancel or suspend the registration of a person under this section if the person is found guilty of an offence against this Act.
The NT EPA must:
(a) cancel the registration of a person registered under subsection (3)(a); and
(b) cancel the registration of members of a class of persons registered in the register under subsection (3)(b),
if the NT EPA ceases to be satisfied that the person or class of persons should be registered by virtue of qualifications or experience.
