Immunity

In force

(1)

The

Commissioner and police officers are not civilly liable for an act done or omitted to be done by them in good faith in the exercise of a power or performance of a function under this Act.

(2)

The Commissioner and police officers are not criminally responsible for an offence against this Act or the Criminal Code if:

(a)

the Commissioner or police officer is, at the time of the offence, exercising a power or performing a function under this Act;

and

(b)

the conduct is reasonable in the circumstances for exercising that power or performing that function.

(3)

Subsections (1) and (2) do not affect any liability the

Territory would, apart from those subsections, have for the act or omission.

(4)

In this section:

exercise of a power includes the purported exercise of the power.

performance of a function includes the purported performance of the function.
