Building Act 1975

This section applies to a person authorised by the former council under section 246CP(1) of the unamended Act as a person to whom a document must be produced.

On and from the commencement, the person is taken to have been authorised under section 246CP(1) of the amended Act as an investigator by the QBCC commissioner.

Action taken for an investigation under the unamended Act continues to have effect for the purpose of the amended Act.

If a notice given by the former council before the commencement under section 246CP of the unamended Act required a document to be produced at a time that is on or after the commencement, the notice is taken to require the document to be produced at that time to the QBCC commissioner.

Subsection (6) applies if, immediately before the commencement—

an identity card had been issued to the person under section 246CQ of the unamended Act; and

the card had not expired according to its terms.

The card is taken to be an identity card issued to the person by the commissioner until the earlier of the following—

a new identity card is issued to the person by the commissioner under the amended Act;

the card expires according to its terms.
