50B Reopening investigations, other than inquests
The State Coroner may, on his or her own initiative—
reopen an investigation into a death; or
direct the coroner who conducted an investigation into a death, or another coroner, to reopen the investigation.
The State Coroner may take the action mentioned in subsection (1) if the State Coroner considers—
the circumstances of the death warrant further investigation; or
the coroner’s findings could not be reasonably supported by the evidence; or
new evidence casts doubt on the findings.
The coroner who conducted an investigation into a death may, on his or her own initiative, reopen the investigation.
The coroner may take the action mentioned in subsection (3) if the coroner considers—
the circumstances of the death warrant further investigation; or
new evidence casts doubt on the findings.
The State Coroner, or another coroner, who has reopened an investigation under this section may accept any of the evidence given at the earlier investigation as being correct.
In this section—investigation does not include an inquest.
