Power to require information
43 Power to require information
This section applies if the registrar reasonably believes—
an offence against this Act has just been committed; and
a society may be able to give information about the offence.
The registrar may, by written notice given to the society, require the society to give information about the offence.
When making the requirement, the registrar must warn the society it is an offence to fail to give the information, unless the society has a reasonable excuse.
The society must give the information, unless the society has a reasonable excuse.
Maximum penalty—400 penalty units.
It is a reasonable excuse for a society to fail to give information if complying with the requirement might tend to incriminate the society.
