Delegate for investigation
20 Delegate for investigation
If the public guardian decides to investigate a complaint or allegation, the public guardian may delegate to an appropriately qualified person the public guardian’s powers under this part, other than the power to give notice under section 25(1) or 29.
Subsection (1) does not affect the public guardian’s authority to delegate power to someone else under section 146.
A delegate exercising power under this part must, if asked, produce evidence of the delegation.
If a delegate is given power to carry out an investigation, the delegate must, after carrying out the investigation, make a written report and give a copy of the report to the public guardian.
It is a lawful excuse for the publication of any defamatory statement made in the report that the publication is made in good faith and is, or purports to be, made for this Act.
A delegate (other than a delegate who is a member of the public guardian’s staff) given power to carry out an investigation is entitled to the remuneration decided by the public guardian.
