Approval to investigate other land or infrastructure
56I Approval to investigate other land or infrastructure
This section applies if, while carrying out a development investigation, the Coordinator-General considers it is reasonably necessary to enter land (the additional land) other than the land identified in the investigation notice for the investigation.
The Coordinator-General may recommend to the Minister that a direction be given to the Coordinator-General to include the additional land for the purposes of the development investigation.
The Minister may give a direction mentioned in subsection (2) if the Minister is satisfied—
the additional land is—
land on which the resources project the subject of the development investigation is, or is proposed to be, located; or
land on which existing or proposed infrastructure mentioned in section 56(2) is located; and
it is reasonably necessary for the Coordinator-General to enter the land for the purpose of carrying out the development investigation.
If a direction is given under subsection (3), the Coordinator-General must publish a gazette notice amending the investigation notice for the development investigation to identify the additional land as land the subject of the direction.
Section 56A(3) applies in relation to the gazette notice published under subsection (4) as if it were a gazette notice published under section 56A(1).
Section 56B applies in relation to a direction given under subsection (3) as if it were a direction given under section 56(1).
