Surrogacy Act 2010

The affidavit sworn by the other birth parent must address the matters mentioned in section 22(2)(a) and (h) (to the extent it is a matter regarding the other birth parent) and (2)(e)(vi), including by stating—

the understanding of the other birth parent of the social, psychological and legal implications of the surrogacy arrangement and the making of a parentage order; and

the understanding of the other birth parent in relation to openness and honesty about the child’s birth parentage being for the wellbeing, and in the best interests, of the child; and

that the other birth parent did not receive any payment, reward or other material benefit or advantage for a matter mentioned in section 10(a), (b), or (c).
