37 Other order if deceased intended parent

(1)

This section applies if—

(a)

there were 2 intended parents under a surrogacy arrangement and the 2 intended parents were a couple when the surrogacy arrangement was made; and

(b)

one of the intended parents dies before a parentage order is made.

(2)

Without limiting section 36, if the court makes a parentage order transferring parentage of the child to the surviving intended parent, the court may also make an order declaring that the deceased intended parent is taken to have been a parent of the child.
