75 Carrying out cadastral surveys

(1)

A person who is not a registrant must not carry out a cadastral survey.Maximum penalty—100 penalty units.

(2)

A person who is a registrant must not carry out a cadastral survey if the person is not a cadastral surveyor.Maximum penalty—100 penalty units.

(3)

However, a person does not commit an offence against subsection (2) if—

(a)

the person carries out the cadastral survey under the supervision of a cadastral surveyor; and

(b)

the level of supervision by the cadastral surveyor complies with a guideline mentioned in section 188A(2)(a).

(4)

In this section—

registrant does not include an emeritus surveyor.
