Towing authorities

11 Towing authorities

(1)

A towing authority is a document that—

(a)

is in the approved form; and

(b)

states that a particular person who is the holder of a driver accreditation is authorised to—

(i)

tow a motor vehicle damaged in an incident in a regulated area from the scene of the incident; or

(ii)

tow a motor vehicle seized in a regulated area from the place of seizure; and

(c)

is given by—

(i)

the owner of the motor vehicle or the owner’s agent; or

(ii)

an authorised officer.

(2)

An authorised officer may give a towing authority for a motor vehicle only if, when the authority is given, the owner of the vehicle, or the owner’s agent, is absent from the vehicle or is incapacitated.
